Sample Roommate Agreement


The most important factor in keeping good relations with your roommate(s) is a clear understanding of the rental agreement and an agreement of each others responsibilities. You could end up paying for damages caused by an irresponsible roommate(s) or you may get stuck paying a roommate’s share of the rent. You should be aware when you and your roommate(s) all sign the lease; you will be considered “jointly and severally liable.” This means the landlord may, at their discretion look to all roommates or one roommate for the rent; this becomes significant if your roommate(s) move out and/or violate the terms of the lease. You could be held individually responsible for paying the total amount due on the lease and assume responsibility for damages.

It is also important to clarify some important issues with your roommate(s) before problems arise, even if you are good friends. The best time to do this is before you have even selected your apartment. You will want to discuss the issues noted below before you move in together.

  • Property. Be sure there is clear understanding of who brought what into the rental unit. Clarify any “joint” purchases/items. Discuss sharing of property including books, clothing, appliances, food, etc.
  • Cleanliness. Spend a moment and discuss expectations about common living areas. In particular, establish an understanding concerning the bathroom and kitchen. Discuss cleaning responsibilities, dirty dishes, bathroom counter space, and any other shared areas.
  • Privacy/Quiet Times. Discuss quiet times including studying and sleeping. Consider who needs how much sleep and how schedules might conflict. Set some guidelines about privacy on the phone and in personal rooms.
  • Guests. Friendly visitors dropping by unannounced on a quiet evening rarely cause problems. Significant others moving in for the semester, on the other hand, can indeed lead to strained relationships. Discuss visitors and overnight guests.
  • Food. Particularly when a large group is living together, label food and explain what, if anything is available for common consumption. Provide space for personal storage of food items.
  • Money. Be sure everybody understands their responsibilities to pay rent, phone, cable and other utilities. Develop a system for prompt payment of all bills.
  • Phone. As noted above, discuss phone bills and privacy. In addition, consider a system for taking messages and discuss phone usage.

This is particularly important for groups of individuals (3 or more) living together. It is also very worthwhile for roommate pairs to discuss. This may seem a bit formal for a group of friends living together, but in the long run, it will probably pay off. It may also be helpful to make a list of everything and clarify; sign and everyone gets a copy. Use the sample agreement below as a guide to clearly spell out the rights and responsibilities of each roommate, so everyone knows what's expected.
